Uncle Judge phenomenon-Blot on our Judiciary..”Eighth wonder of the world-An IPS officer becomes DGP at least after thirty years of service but a practising High Court lawyer becomes High Court Judge overnight IIcourtesy Collegium system which produces “Uncle Judges”black spot on our judicial system.Everybody in Judicial circles knows about these discrimination but none is ready to bell the cat.Time has come for nation wide debate over the utility of Collegium system.Old proverb says that Caesars wife should be above board but here the role of Caesar’s is under cloud as they choose their relatives as high court judges.It is learnt that Supreme Court collegium is considering a proposal to pause recommending family members of a sitting or former constitutional court judges as high court judges to dispel a widely -held perception that these lawyers get priority over first generation lawyers in the judge selection process.Recall that SC bench a decade ago has struck down the National Judicial Appointments Commission which was brought in unanimously by the Parliament to replace the collegium system.Nothing new only eye wash as this practice of interaction was initiated and being followed during CJI term of Deepak Mishra, Ranjan Gogoi and Sharad Bobde. So not a new introduction.This practice of uncle judges’ is coextensive with present prevailing Collegium System. Nothing tangible can be achieved unless some transparent system of appointment of Judges is introduced.In past many a times uncle judges’ issue was seriously deliberated upon but of no avail. This time also it will meet the same fate.Govt. also wants committed judges instead of those honest and fair who in given eventuality would not bow down before it.
