Alleged that home buyers are suffering due to alleged collision between Officers of Town& Country Planning Department and Real Estate Regulatry Authority, Panchkula.? 1. Biplab Kumar Deb 2. Sanjay Mishra, Officer on Special Duty, Office of Sh. Biplab Kumar Deb. I Dr. Akhil Mahajan R/o Faridabad would like to bring to your kind attention as below:-
1. That I am president of Heritage Cottage Home Buyer Association and we are facing difficulties in the possession of the flat due to collusion of the Town & Country Planning, Department and RERA Panchkula .It is brought to your kind notice the DGTCP, Satyaprakash Ji granted hearing in contravention to the rules in Licence No. 34-36 of 2007 issued to Maximal Infrastructure Pvt. Ltd. In this case, CWP No. 29580-2022 was filed on 21.12.22 and was lastly heard on 11.01.24 and is now listed for hearing on 23.04.24. State has failed to file reply in this case as this illegal hearing has been granted against the contravention of The HDRUA Act, 1975 and thereby stalling the project because of interference by the govt.
2. That It is very painful that Town & Country Planning, Department is playing in the hands of builders. The IAS officials of Town & Country Planning, Govt. of Haryana are not accessible to common man in the State of Haryana.
3. That undersigned had very bad experience with the then DGTCP T.L. Satyaprakash Ji who despite of being told of the irregularity insisted on reviewing & revising the orders in Licence No. 34-36 of 2007 LC No. 810 throwing to wind all established procedures in The HDRUA Act, 1975.
4. That Arun Kumar Gupta, IAS ACS, Town & Country Planning Department, Govt. of Haryana also supported the DGTCP and got post facto approval from Chief Minister Manohar Lal against the rules.
5. That the RTI documents are with us which proves the nexus how in subjudice case CWP-4383-2022 & CWP-5386-22, was reheard by the govt. on the last day of the final argument pending before Hon’ble Punjab and Haryana High Court at Chandigarh.
6. That there are no such provision in the rule to rehear of revise the case once appeal is dismissed u/s 19 of The HDRUA Act, 1975.
7. That undersigned has also given a complaint in Deputy Commissioner Faridacd office, to enquire about the illegal action taken by these two Officers against the interest of the home buyers in State of Haryana for placing it before the Chief Minister of Haryana. But, no response has been recevied till now.
8. That home buyers are waiting for the houses for last 16 years because of the deficiency in the RERA act and defects in the change in beneficial policy of 2015 enacted by the TCP, Govt of Haryana department which is a matter of serious concern where despite directions given by the Ministry of Housing, no action was contemplated by Town and Country Planning Department to amend that section 37 & 38 of The HRERA Act and deficiency in the beneficiary interest policy like NOC clause which has been struck off by the Delhi High Court in Co.Pet No. 39/2009 pending before Hon’ble Delhi High Court.
9. That there is no will by town and country planning department to look in the loop holes by which builder are amassing unaccounted wealth, making shell companies at the cost of innocent home buyers where govt is mute witness.
10. That in LC-810, benefit of Rs. 25 Cr. was given to builder in Samadhan Se Vikas policy without inserting any clause for completion of the project which is handing fire since 2006 because of collusion of TCP officials, and RERA officials who have no will power to curb the unethical practices adopted by the builders & these Officers are hindrance in achieving 5 trillion economy by our country and this is a bitter truth and even DGTCP has not filed reply in CWP-19954-2022.
THEREFORE, it is prayed that the TCP department be directed to file reply in CWP No. 29580-2022 & CWP-19954-2022 as more than one year has passed and enquiry should be instituted to look in to my grievance as 3000 home buyers are affected by the dilly-dallying attitude of the DGTCP office and RERA, Panchkula .Efforts to know version of Arun Kumar and Biplav Deb bore no fruit as they didn’t responded to text message.Author of three best selling books on politics culture and Governance of Haryana including “Tips for Investigative Journalism “Bansal could be contacted at pawanbansal २@gmail.com.January २८,२०२४.
Tailpiece.In this case main case cwp number 12971 /2023 has been decided in favour of home buyers and case cwp number 199954/2022 disposed of by Punjab highcourt where only illegalities were mentioned by High court bench but Dr Akhil mahajan has filed reviewing of orders in cwp 19954 2022 vide cm number 19956 /2024 next date fixed on 02/12/2024 where bench was requested to clarify the orders and punish Hrera officials along with TCP deptt .Bench was apprised of collusion.Your case CM-18656-CWP-2024(AKHIL MAHAJAN V/S STATE OF HARYANA AND ANOTHER) has been Fixed for Hearing on 09/12/2024.
